Yes, this is one of the types of situations that I was thinking. Also, sometimes there are cases where a hero is forced to make a choice, and anyway, there will be someone who is innocent that dies. I think a hero is made more by her motivations and if she tries to do what is best and protect people as best she can than never letting anyone die.
