Re: *TW: rape* Is drunken sex rape?

90% of feminist blog authors and women's studies majors? Yes.

Then again, you also have the crazies who accuse every rape victim of lying for attention, asking for it, or blaming her for being drunk/wearing revealing clothing/walking alone at night.

Two out of a thousand reported rape cases are false. That's less than 1%. Have a nice day.

nayrt, cite your statistics, please. I hear stats quoted all the time with no citations, but don't trust them unless I can see your source.

Yay made up statistics!

I don't really doubt that's true because I'm sure the vast majority of reported rape cases are genuine but if most rape cases don't result in a guilty verdict, how did they prove that only 1% were false? I've always been confused about that

Mmmhmmm, mmmhmmmm. Tell me more about how some group of feminists made up statistics. Or here you go.

Also of note of further manipulation: The figures on the left are larger than the ones on the right. This subconsciously makes them seem like there are more.

Those statistics were disproven, though, because they only counted the rapes that were actually taken to court, not all the fals rape allegations that were dropped because of false claims before there ever was a trial. So that number is not even remotely correct.

Not sure how I feel about this argument

That's talking about false accusations, cases where there was no sexual assault whatsoever and it was just made up, which are certainly extremely rare (although almost certainly a little more common than the infographic you're using as your source depicts, given that they estimate at the very lower end of every range they're using).

But what matters almost as much or more is cases where a sexual assault did (horribly, terribly) occur but where the identification of the perpetrator is incorrect. Or where it's uncertain or where it might be incorrect. That's not a false rape accusation under anyone's terminology. But the fact that most accusations aren't false doesn't mean that we should believer they're totally true, either. We should pretty much always believe that something happened. And we should respond with as much empathy and sympathy as we can towards the victim. But however low the rate of false accusations is, it's never going to be low enough to the point where we should automatically believe that the accused is guilty, either in law or in public opinion. Not because we should disbelieve the victim, but because shit is fucking complicated.

None of this is unique or particular to sexual assault victims - it's the case for every crime, everything, across the board. People make mistakes and get things wrong. But there's a particular impulse, an understandable and laudable one, in the case of sexual assault to believe the victim, to see some kind of justice done, to do something. But while I agree with that impulse, I can't go so far as to say it should overwrite our basic concept of criminal justice.

And the other thing to keep in mind is that, you know, this is still a situation where rape is massively underreported and where there are actual massive institutional obstacles to investigating it seriously, not for any legitimate reason. And that false accusations are incredibly rare. All of these things are absolutely true beyond a doubt, and the justice system absolutely does need to be changed. I'm just not sure a world where everyone accused of sexual assault is convicted would be either possible or good.
