On the subject of out-of-copyright fandoms, there might be a question of whether it is the vanilla version, or is it fanart of a new, in-copyright versions. Fanart of Sherlock Holmes? Well that's fine if it's the original, but if it's the Holmes from the BBC show Sherlock...

But mostly I agree with the line of thinking that fanart is not a straight-up bootleg.

But you'd be making profit off someone else's ideas either way. Terrible! There's a guy fighting ACDs estate in court right now actually, it's been in the news a bit. Imo ownership and theft are a lot fuzzier for this kind of "property" than OP seems to think.
