Legally is what counts when it comes to murder. There are very specific criteria and legal avenues to deactivate someone's lifesupport. That Tony didn't pursue them (and don't tell me Tony couldn't afford the lawyers) shows there was far from no-hope and that he had no legal standing to do it. Hell, if he really couldn't have afforded the lawyers he could have sent an anonymous card to Von Doom saying "Doom doesn't have the guts to do it".
