That's true, but Brooks was one of the people who kind of came up with the whole concept of ripping off Tolkien like that, so you can give him a little more blame for it

As others pointed out, writing is one thing. Getting published and earning money off of another's ideas is another.

Look at it this way: it's the precursor to 50 Shades of Gray, and that One Direction fic that's being published.

I think it's worse than that. 50 Shades of Gray has a distinct plot from Twilight.

Except that 50 Shades of Grey differs from Twilight much more than Sword of Shannara differs from LOTR. Imagine if 50 Shades were about a high school girl named Stella who lived in a small town in Oregon, met a hot vampire named Edmund and had a doomed love triangle with him and a shirtless dude named David who was also a werewolf, etc. etc. and the comparison would be closer.

Except 50 Shades originally began as one of those "All Human AU" fanfics of Twilight that just eventually filed off the serial numbers to get published. A closer comparison to 50 Shades would be Diana Galbadon blatantly using a Doctor Who character in her books and filing off the serial numbers so the BBC wouldn't notice.

...One Direction fic? *baffled face* Well...I have no words, it's not like there's not precedent going back for as long as writing to have fiction about existing characters...
