I think that would be because she's pretending to be another real person. It'd be like if I stole my best friend's glasses and put on a blonde wig to disguise myself as his girlfriend to sex him up while his vision was fuzzy.

...But she's not pretending to be a real person. Yes she and another girl switched names, but the rich orphan with a bunch of philanthropic endeavors and sweet disposition is a fictional construct.

When you take another person's name you are pretending to be them, regardless of whether your behavior matches theirs. You are pretending to be them and using that to sleep with someone who wanted to sleep with the other person. That is rape.

Daniel would not have actually wanted to sleep with the real Emily Thorne because the real Emily Thorne was a ex-juvie stripper who played fast and loose with men and liquor and had no high-class breeding at all. What Amanda took from her was only her earliest history -- being a foster child who ended up in juvie, which is pretty much her own story minus the terrorist father -- and her name. If I were to change my name to Samantha Jones and a real Samantha Jones existed, would that mean I was pretending to be her?

IMO the issue is less "would Daniel have wanted to sleep with the real Emily Thorne" and more "would Daniel have wanted to sleep with the real Amanda Clarke. Not the OP, but in agreement: I think the secret is saying that Daniel would *not* have voluntarily slept with AC, and that by not saying that she's really Amanda, she is taking away his consent. Especially since her strategy was not "I am a different person entirely, leaving behind my complicated past as Amanda Clarke", but "I am pretending to be a different person entirely, for the purpose of destroying the people responsible for the past complications".
