25. An honest question - what's the difference between using official art for iconage and fanart? Not even attempting to be snarky, I'm just curious.

Original artists don't cry and throw temper tantrums when you use their art.

The argument that tends to be used most is that everyone in the fandom would be able to recognize the official art and know where it came from. With fanart, it's more difficult to know where the source of the image came from. Japanese fanartists also tend to have different views on how images are to be used in fandom. They even look down on even using official images on their sites and prefer to redraw an image in their own style instead of using it. (Or so that's the impression I've been given...)

I think what it boils down to is that Japanese fandoms have different rules of conduct as their English counterparts and that's where most of the conflict comes from.

Official art is a commodity, I suppose. It's still not technically legal to use it, but the source can be easily found, the artists are being paid for their work and all that jazz.
I suppose that studios wouldnt' be opposed to people using their official artworks as it promotes the series and is free advertising of a sort.

Fanart is a little different because the person responsible is an individual, not a studio. It's very difficult to find the original artist without having to ask others (who might not know), the art is not viewed on the artist's own terms, it's also very discouraging and the artist may remove themselves from the internet, like many have done after being frustrated by the 'cry moar' attitude.

It usually isn't made for a commercial purpose either, it's somebody's hard work made in their free time and it would be nice if people respected the artist's wishes.

Official art bears an actual copyright that would hold up in court? I suppose that doesn't help 25's side of the debate, though.

Because a lot of the time the original fanartist will shut their entire site down because of it.

EDIT: Not blaming the fanartists themselves, as everyone is guilty in this debate. I have even less respect for those who icon fanart then demand credit for them. >.>
