Re: tw rape - thread the other day had some worrying comments

Could you clarify your position?

Can a woman rape a man by deception if she says her name is Cindy but her real name is Jenny? What if she says she's a nurse, but she's really an accountant? What if Jenny says her name is Jenny, but fails to mention that she's a convicted felon? Is Jenny a rapist?

Yes, yes, and maybe depending whether or not she was asked was she a felon.

So you're saying any sex worker using a pseudonym is automatically a rapist?

If she doesn't disclose that she is using a pseudonym. Most sex workers, in my experience, are pretty upfront about not using their real names and will ask the customer what he wants to call them and will only give a pseudonym if pressed. If the customer wants to commit to sex after that, then he or she is giving informed consent.

"whether or not she was asked"

What. If someone pretends to be your boyfriend and has sex with you in the dark but never outright states "I am your boyfriend", I wholeheartedly disagree that this is suddenly not deception because you never explicitly asked, "are you my boyfriend"

Reasonably expectation kicks in on that one.

This is why I don't buy it when someone in fandom claims to be a survivor of rape.

what because they were to stupid to get deceptive regularly or make the whole shit up?

make a false rape/claim and being personally deception by it isn't the same thing.

So what now , that you to identify someone via legally to prosecute or attack a person verbally just because lie a name. Stupid, both of persons that intercourse shouldn't have concern on lying or don't sex at all.

Well , though of one night stand is fun, but now lying is fucking crime.

NA

Actually, it's a little more complicated than is being presented. If the person is getting consent by the deception, that is, that it can be reasonably determined that without the deception the person would not give consent, then it is rape by deception. So Jenny could be, but it depends on intent.
