SCOTUS Ruling On Same-Sex Marriage

Is anybody else worried about it? I'm trying to be optimistic that they'll do the right thing and legalize it, but a part of me is just so cynical about it.

I'm somewhat worried if only because the current makeup of the court is fairly conservative. Mostly I think that culture has moved so much in the direction of being pro- same-sex marriage that it would be surprising for them to rule that way. But with Scalia, Roberts, Alito, and Thomas on the court you never know.

Having those four dudes on the court doesn't mean anything if they can't move anyone from the other 5 - and I have no idea who that would be.

I would say it's more likely that Roberts comes down in favor of gay marriage than that any of Kagan, Sotomayor, Breyer, Ginsburg, or Kennedy come down against it.

Alito, Scalia, and Thomas are definite nos; Breyer, Kagan, Ginsberg (<3), and Sotomayor are yes's. I think it'll come down to what Kennedy and Roberts have to say.

I'd be surprised if they didn't legalize it, however.

I think if they were leaning toward not legalizing, they wouldn't have denied the stay on same-sex marriage in Florida.

The current makeup of the court leans conservative but their rulings don't tend to be consistently conservative or consistently liberal. It's down to the swing votes, though, but I'm pretty sure at least Kennedy is going to swing for legalization.

RBG has been talking positively about the subject in public appearances, so that makes me hopeful.

She has NOT been talking about ACA at all, which really, really worries me.

I'd say there's about a 95% chance that they'll legalize it. The four liberals are obviously yes votes and I would be absolutely stunned if Kennedy wasn't as well. I can hardly even imagine what sequence of events would lead Kennedy to vote against.

I wouldn't worry too much if I were you. It's very hard to take back rights (or an acknowledgement of rights) that have already been won. Many of the Justices have spoken in favor of legalization, and lbr, the swing votes probably don't want to go down in history as the guys who voted against civil rights.

That's true, but only insofar as Kennedy is the swing vote. I don't think anyone else on the court would give a shit about how they go down in history in that way. But Kennedy certainly does.

I don't think the conservative wing cares at all - maybe Roberts, a bit, but Thomas cares about his intellectual principles and Scalia his faith and Alito his partisan hackery more than any of them care about the verdict of history. And if any of the liberal wing cares about it (maybe Breyer might) I think they'd feel comfortable that they were already on the right side of history anyway.

I'm sure they care about posterity on some level - but except for Kennedy I don't think it would influence their votes, is my point.

Scalia still equates gay relationships to Sodomy. So yeah, he doesn't give a shit about being seen as a villian in a no vote against same - sex marriage.

I honestly don't know....seems like it could go either way. I hope it gets legalized. Opinions are definitely changing, so I think there's a fair chance.
