This is a good comment.

My one caveat with it though is the blanket "Not looking at" how the accuser acted. I mean, obviously, acting provocatively is no defense for the "teasing bitch shut me down?! I'ma take her anyway!" variety of rape, nor is it a defense for "well, she seemed interested before; I'll just have at it while she's passed out." But when (non-tampered with) alcohol is a factor and the accuser seems very into or perhaps even initiates intimacy, that seems like a pretty good defense for the accused. Because we can't expect other people (especially other inebriated people) to peer into our heads and intuit whether our demonstrated interest in genuine or if maybe we're really blackout drunk in there.

But I know that's getting awfully close to imploring women to be mindful of how we drink in order to avoid a bad situation, which is hot-button issue.
