There is an exception for parody under U.S. copyright law. But not all fics, fanart, etc. are parodies, and therefore not necessarily covered by that exception. OP may not be comfortable with that. Now, it would arguably be hypocritical to be okay with say, fanart that's not a parody, but not okay with fanfic that isn't a parody. Neither is legally covered, but historically, fandom has been much more comfortable with art than with fic. It's not entirely logical, but that's the way of things.
