At no point could the money ever be considered belonging to the inheritors. It's more like having an overdue library fine - you sort out liabilities first. After that, what's left is what you're leaving to your heirs.

Though at the end of the article it does say that her insurance pushed her to sue (I guess before they would pay out?). Ugh, it's fucked up.
