Bankruptcy

(Anonymous) 2016-01-28 12:09 am (UTC)(link)
Has anyone here filed for bankruptcy? Particular the medical kind?

My sister recently had a long illness that has racked up around $5000 in debt. There is no way she can pay this. She has been fighting with the hospital to send her an itemized bill. They keep saying she should get one but she never does (meanwhile they are sending her collection papers).

She also has a credit card payment she has been paying off. She has a job and is responsible but the illness just wiped out everything she had. So, I was looking into filing for [medical] bankruptcy.

She doesn't want to because it makes her feel ashamed (she doesn't think $5000 warrants that kind of thing) but I think that she should.

I haven't, but my parents did, and also due to medical reasons. Once my dad lost his job due to his illness (and he'd had pretty decent health insurance through that job, too, so losing that really hurt), the amount of red tape he and my mom had to go through just to pay for typical medical bills and handle the ridiculous debt, as well as pay for other necessities for him, was insane. And this was before the Obamacare thing was implemented, too.

I sympathize with your sister's feelings about doing this, it's a very awkward, tough thing to go through and deal with. But if it's the best/only option available to her... She has my sympathies on all of this.

Can she borrow money from friends or family to pay it off? This is going to completely tank her credit for the next 7-10 years. Meaning she's going to have a hell of a time getting loans for anything and/or moving living areas and/or getting a car or phone or insurance if she needs to. If there's any way to avoid bankruptcy, she should avoid it.

SA

except by taking a payday loan.

This. $5000 is a ridiculous amount to declare bankruptcy over when you consider the long-term impact to your credit score and how difficult it will make a lot of things.
