And he happily let Draco have a go at her every chance he got, even when Lucius Malfoy himself obliquely pointed out Draco was only screwing himself over being so openly spiteful and racist.

It's possible to commit an act by omission - that is, failing to do something that ought to be done, and not shutting Draco Malfoy up is such an example.
