What legal precedent? That if you post a sex tape of someone without their permission you will get sued into the ground?

I don't think that's the entirety of the legal grounds in this specific case - there's a whole lot of stuff about public image and interest that gets wonky - although I agree from a moral point of view that they absolutely shouldn't have posted it.

The precedent is that if it hurts a persons ability to generate income then you cannot report on anything which shows them in a bad light. You can see why this might be a problem? And also why a right-wing Florida Jury might love it.

Bullshit. A sex tape is far different thing from Knight Rider wallowing around drunk with his Wendy's burger. You do not post sex tapes without a person's permission, period.

That's - AFAIK - a moral distinction but not necessarily a legal one.
