Re: TW Rape

NAYRT and I think they were rude. But in this instance, we're not talking about the United States' general policies regarding incarceration. We are talking about whether or not 6 months is an appropriate sentence for a rape. Which is not - to me - a lesser crime, and in this case no one would say there was lesser evidence.

And the fact that you're ignoring that basic reality is what's baffling to so many.

By "lesser crimes" I meant lesser than this one.

You know, I want to apologize. I posted hastily. Six months does sound really short. It was a heinous thing he did.

But I'm going to stand by most of what I said even if I lose all the respect of everyone here.

Most rapes aren't prosecuted. Many rapists will get no sentence because no case can be made. I'm not going to whine about someone actually getting a felony conviction just because he didn't get the sentence I would have chosen. Calling for vigilante justice in this case is silly.

Six months is probably pretty close to the appropriate sentence for a first offense. It would have been close enough for Cory Batey, too--but he was a black man in Tennessee.

It's not that I don't appreciate how bad rape is. It's that I don't think you appreciate how bad confinement is.

I think the fact that someone actually got a felony conviction is one of the things that makes it so frustrating. Because the unreasonably high bars that have to be passed to bring a case to trial, and to get a conviction, were passed, and then the sentence is something that - in the context of the American justice system - is extremely minor.

And, with respect, I don't think that six months is the appropriate sentence for the first time a person tries to rape someone. Like, it's an extremely serious crime. I don't think spending a couple months in prison is an appropriate punishment for that - yes, I know, confinement in and of itself is bad, especially in the American prison system, but this is also an extremely serious and violent crime.

At the end of the day, I think it is unreasonable to expect people to start the fight against the American justice system with rich white rapists. That's just how it seems to me. I think it's a good cause, I think this is about the least useful case on which to argue for it.
