If they can say yes and mean it, it's okay. (As for telling whether they mean it, how would you tell with someone who wasn't "noticeably autistic"?)

If a neurotypical person said "Yes" but didn't mean it, that's on them, That was their choice not to communicate what they felt. If an autistic person said "yes" they might not even understand that they didn't mean it until it's far too late, and that's not their fault.

That's a good point

I think I'd take the same mindset when deciding if someone is too drunk to consent: If you have to ask, she's too drunk. If there is even a question that it might be wrong, assume it's wrong.

This is NOT an okay measure.

A young teen could say yes and mean it. That doesn't make it any less statutory rape.

Statutory rape is not necessarily unethical. 50% of first relationships in my country would be statutory rape in some others .

An adult with a young teen, always unethical. Period.

Older teen with an adult who is not too far off in age? maybe. it's gray and depends on the situation.
