On the one hand, by the time people actually file for divorce, they've usually already checked out of the relationship emotionally and have tried and failed at counseling or whatever attempts they were going to make to save it. The fact that he's still legally married pending finalization of the divorce isn't a problem unless you want it to be.

On the other hand, if finalization of the divorce is only waiting on his signature and he just can't be bothered, then that's potentially troubling since it could suggest he might not be over his ex, or he might not be ready to commit to someone else, or he might not care enough about your sister or any other future partners to actually make himself available to marry them, or he isn't in a hurry to make himself available, or he might be trying to punish his ex by preventing her from marrying anyone else.
