Uhh no you have no reason to pass someone who is going at least the speed limit. They are allowed to fluctuate their speed, you should learn how to adjust accordingly. If you can't, it's you who needs to learn how to drive.

My reason is that I don't want to be trapped behind someone who's driving erratically. I can certainly adjust my speed, but the fact that they can't control their rate of acceleration might also mean their reflexes and judgment in other areas are poor. If they get some random urge to slam on the brakes and I can't stop in time, I'll be held liable even though they're a terrible driver.

Your first sentence doesn't even make any sense. If you want to go faster thanthe person ahead of you, that's a good enough reason to pass them.

DA -- Absolutely. No one should have to follow an erratic driver just because that person doesn't like people passing them. As long as it's legal to pass, then get away from the terrible drivers before they cause an accident and blame you for not being psychic.
