I think in fanfic-world, Mary Sue generally only applies to OCs. I don't think you'd get crap for writing about an existing character.

The Internet is full of some very strange people, so the possibility exists that you can get crap for doing anything at all. But it's not likely, or meaningful, would be my point.

I think sometimes when characters are written in an OOC way (or in a way that the criticizer perceives as OOC) it can still get the Mary Sue label.

I assumed OP was talking about the character they'd create so Charlie could have the romance? The one she meets while working a case? But I could be wrong.
