I feel like because the Joker's insane, he can't decide whether he wants to kill Batman himself (a victory) or keep him alive for more play-dates (also a victory). And if he doesn't try his hardest to end Batman, he's letting them both down. It's his personal moral code; kinda like Bats has his own moral code not to kill anyone.
One day you get a murderous Joker, the next he's just toying with you.
Point is, he's unpredictable and dangerous and I don't think it's OOC for him to act one way or another.
