That's not the working of the Accords. None of those people had signed the Accords. Therefore the consequences to their actions were not based on the Accords.

Secondly, you can't imply that this is a matter of war and then complain about due process. You can absolutely detain enemies indefinitely on a battlefield, lol. And even if it was a matter of a state's law, we don't have enough information to determine if due process for the whichever state controlled was followed. Not every state believes due process means a hearing after a certain amount of detainment, and the US has a national security exception to everything.

Thirdly, if, as Tony has argued, Bucky was being evaluated for psychiatric treatment (because he was a danger to himself or others), then he wasn't being detained for questioning about a crime and would have no right to an attorney. Also, even if Bucky was detained for questioning, Steve can't invoke the right for him. Only Bucky can. I'd (it wasn't Ross who laughed it was some other dude) laugh too because that's a "I watched law and order" understanding of the law.

There were not on a battlefield. Unless some government agency officially declared war on the Avengers, there is literally no way they can keep them without due process.

Do you think Gitmo is a great place that should exist?
