I think it would depend on me whether they were actually sentient. Which is probably difficult to tell. But Data is clearly a living being, and doing that to him is slavery.

Well, legally he is a person. But is he truly sapient or is he just extremely well programmed to emulate sapience? Is C-3PO a person or an appliance, what about Kryten from Red Dwarf? They arguably show many more indicators of being truly sapient than Data but are both firmly (by choice in the latter case) in the appliance camp?

AI is such a complex issue.

I would generally tend to err on the side of 'person' if it's close enough that that's even a question at all. If a being might be a person, treat it like one. The worst that can happen that way is that you maybe make a fool of yourself apologising to a toaster. The worst that can happen erring the other way is ... well, a lot worse.

Oh you had to bring the toaster into this?

Well, you know. It's not his fault. Some toasters, much like some people, are just annoying.

He was assembled this way?

Weren't we all?

Ah, the key difference between true sapience and sapience emulating AI. Sapients are able to change their software on their own, sapient emulating AI need to upgrade their hardware before experience character growth and even then are limited by the skills of whoever constructed their new mechanicals.
