It's actually not illegal. It's only illegal if it can be accused of being Obscene. But under actual REAL LIFE CHILD PORN laws, they are not illegal because a real life minor/child is NOT recognized or depicted.

And the Obscenity Laws can be VERY subjective in general, so...yeah no.

That is true, yes, but the US has separate laws and what those assholes on Tumblr are crowing about would be subject to Obscenity Laws, not Child Porn.
