If she doesn't make it clear that she isn't a lawyer, and the clients assume she is, the lawyers could actually get in a whole lot of trouble. So this is a pretty big deal, not necessarily for her, but for Matt and Foggy it is. They could lose their licenses.

I haven't watched the series - does she actually say it in a way where she's implying she is a lawyer?

(nayrt, btw)

It actually doesn't matter under the ethics rules for lawyers. If the client can reasonably interpret her statement as saying or implying she's a lawyer, that's enough to get the actual lawyers in trouble.

She introduces herself like "I'm with the law firm of Nelson and Murdoch" without actually acknowledging that technically this is true, but she's a secretary. She also counsels Frank Castle during his trial that he needs to take the stand-- something which most defense attorneys STRONGLY try to avoid, BTW, because it exposes their client to cross-examination usually hurts more than it helps. Castle takes the stand and ends up torching his own defense by going full psycho in the court room.

If that had happened in real life, you'd probably have a mistrial at best, because it means the defendant isn't getting a proper defense from his legal counsel. Nelson and Murdoch would face disbarrment, for allowing their secretary to serve as legal counsel. And there are usually legal repercussions for misrepresenting yourself as an attorney when you're not one, so Page would've been in trouble as well.

Good thing the show is fictional. These fictional characters won't lose their fictional licenses over a fictional issue.

You can still be annoyed at fictional things

No, but someone involved in the field is allowed to be bothered. Doctors are often bothered by tv/movie medicine. It's the same principle.

If they are so bothered by inaccurate portrayals of law I'm guessing they avoid watching all shows that focus on it.

Really? There are some shows that are entirely lawyer shows that I will avoid because they get so much wrong. But this is a superhero show with a side of law. I'm allowed to watch something and still be bothered by something.

Your world seems very black and white. Surely you're aware that there are degrees of inaccuracy to media portrayals of well, everything? And that people can be okay with say, a level 3 inaccuracy, but a level 8 inaccuracy is a dealbreaker for them personally?

This can't be a new and unheard of phenomenon for you, because that's how all personal preferences work, so I'm not sure why you're getting somewhat snippy about what is or is not a dealbreaker for someone else.

+1

Marvel series and movies aren't realists, so expecting such thing is pointless. And TBQH this all feels like an excuse to keep hating a character that has been hated by most people from the beginning, before she did any of this.

(Anonymous) 2016-11-22 02:57 am (UTC)(link)
Yep. I'm surprised no one has brought up the "what if a non-lawyer watching the show saw Karen do it and think it's okay????" argument.

(Anonymous) 2016-11-22 03:11 am (UTC)(link)
I think there are some people who hate the character, and some people (mostly lawyers) for whom it's a pet peeve or something. And, you know, it being a pet peeve is fine. Let's not make a federal case of this.

(Anonymous) 2016-11-22 06:41 pm (UTC)(link)
Just because there are superheroes in it doesn't mean that nothing else has to make any sense, though.

I have bad news for you: people in fandom have all sorts of feelings about fictional characters and this community is all about those feelings. If this bothers you, you might want to hang out elsewhere.
