Sure, it's totally fair.

I've seen this as a criticism in two ways. The first is when someone is using it to say the writing isn't very good. I've read a lot of awesome fic, but let's be honest. Most fanfic is not awesome. It's cliche and tropey and incestuous in style. Think... Joss Whedon's dialog. Every character sounds the same and makes the same kind of jokes. Fun and sometimes compelling, but mostly shallow. That's most fanfic.

The other way I've seen it is when someone is saying the media relies too much on playing on audience familiarity or nostalgia, without offering anything of real substance.

You put it well. I think those are definitely two ways that the comparison is used, and yeah, it can kind of suck for fanfiction to be looked down on - but like you said, a lot of fanfic, while enjoyable, is not that *good*. And I agree with your second point as well.
