Plus they didn't know it was possessed. It was more just contraband goods. Lucy is still a dick for doing it, but it was more just to get Arthur into trouble at the ministry when his kid was caught with a "dark" artifact. The Malfs didn't know Tom was hiding in there.

Let's face it, Arthur kinda deserved to get into a bit of trouble since he was abusing the muggle artifact rules to hell and back for his own personal enjoyment, so just catching a bit of heat over a misused artifact was something he deserved.
