Well, there can be more than one villain in a story, and not all villains have to be serial killer level. Emmit admits he knowingly tricked his brother out of his inheritance by playing upon his ignorance and lack of social status. That's something his brother had accused him of doing all along, but Emmit had always denied and indulged in some low level gaslighting by blaming it on his brother's paranoia. That's a bit more than just douchey, in my book. I'm not even that close to my siblings and I'd never do that to them.
