We can talk fuzzy hypotheticals until the cows come home. The facts are:

1. Spacey and Rapp were professional colleagues working in New York at the time. Rapp was specifically invited because of the show he performed in. There's no false identity going on here.

2. Even if Rapp had been of the age of majority, the actions of forcibly throwing him onto a bed, and physically climbing on top of him without consent would have been sexual assault anyway.

EDIT: And a lot of adults do, in fact, talk about the kinds of sex we want to have with each other, as part of foreplay no less.
