It's not the authors who are using the tag incorrectly, it's the readers who have decided that it's a warning of dark subject matter, instead of an indication that the author isn't going to use warnings.

It's like any other "proceed at your own risk" sign. You might not run into anything dangerous, or you might step in a pothole and break your ankle, and it's up to you to take any necessary precautions to avoid the latter eventuality.
