Agreeing with the others regarding the justice system in the US, they can put you away for a long time (how many people are held for at least a year before their case is brought to a judge? And that's just the tip of the iceberg...I'm not even gonna get into race)

That said, the song always did piss me off because there would certainly be things that that one might do that would cause me not to wait for you. So I would need to know what happened before I give an answer (Although I'm sure the idea behind the song us that the person's love is so real & loyal, it wouldn't matter what the guy did to end up locked up).
