What James did to Snape is the equivalent of pantsing someone, which while embarrassing is not at all sexual assault. Not to mention the spell was Snape's own invention, and he clearly introduced it to the school, and as we find out later, everyone was using the spell after a while; it became the new fad. It's a bit of a stretch to say that practically every student at Hogwarts was going around sexually assaulting each other.
