Yes to both of these, but especially the first one. Although, lawyers know that her case was legit. At least, we studied the case at my law school. But her case is such a big example of how what people think happened doesn't actually match the reality. And she's actually an example of when things actually go right in court. McDonald's deserved to lose that case, and they deserved to get bad press. A shame that the public impression of the case has exonerated them.

Because McDonald's settled with a NDA on her end, so she has to listen to the lies but can't speak up.

Right. I'd forgotten that bit. I speak up every time i hear someone mention the case. But the disinformation goes really far. I feel really bad for her.

It was her decision though, wasn't it? Signing the NDA was presumably part of the settlement she received from McDonald's.

McDonald's would have put it as a condition of their settlement. I don't blame her. She was up against a major corporation and had no idea what she was doing. Her attorney, on the other hand, that person I do blame for not at least having the NDA go both ways.

Her choices were continue an expensive court case for an unknown amount of time, because you KNOW McDonald's would have fucking stalled it into eternity, or accept the NDA and get coverage for her medical bills

Yeah, when I first heard the story as it's commonly told, my impression wasn't "elderly grandma", my impression was some blonde Paris Hilton type. (Since I heard it in 2003.) Poor Stella Liebeck.
