Yeah, they do have the ability to take action and put a beatdown on fans for fanart and fanfiction, but that's not entirely my argument here- and actually, as a kind of aside to my opinion on fanartists, I think any creator of any canon, published work who throws a shit fit about fanart and fanfiction is being semi-disgustingly ridiculous, too. They have the option and the right, but that doesn't mean fanfiction or fanart is a bad thing whether they're cool with it or decide to go insane. Either way, they're not being harmed- it's just whether they decide to overreact or not that's the question, and thankfully, most of the time they don't.

Fanartists do deserve respect, but I think there's a fine line here. If I make a fanart icon, I try to credit it- unfortunately, most fanart I get from the fact that my friends have had it saved to their computers for their personal viewing pleasure for a long damn time and they don't remember where the hell it came from. As for asking permission... this is totally possible and I don't mind doing it, with English fanartists. Not so much with the Japanese ones.

I guess the thing is, asking permission is a nice extra, but the idea that someone would freak out at the idea and say no is kind of... weird anyway, even though I know people do it. I think that's ridiculous, especially as the iconist has nothing to gain from making that icon, and the fanartist has nothing to lose from it being made. Absolutely, across-the-board nothing. And even when it comes to crediting... obviously, crediting is 100% of the time preferable, and there's no reason whatsoever not to. But either way, it's ridiculous to argue that harm is being done: if it is credited, someone who loves the art will go look, see the artist's other works too, and appreciate it. But even if it's not... well, if I see a beautiful fanart icon, I wonder who drew it, and if it's not credited, I'm disappointed. But I kind of try to look into who drew it, out of wanting to see the rest of their stuff, and am thrilled if I ever stumble across it randomly, after. But even if I never found it, the fact is, just from that fanart icon, I have been able to enjoy and appreciate and love an artist's work, whereas if I had never seen the icon, I would not know nor give a shit about that artist whatsoever.

... and in a non-tl;dr way of putting it, free advertising, even if it's not very effective advertising, in no way equals theft. There are ways to be more polite and helpful/useful about it (asking permission, crediting), but as not doing so does not cause harm to the artist, "protection" seems mind-boggling to argue for.

AND WHAT ARE MY THOUGHTS ON YAOI WHILE I'M AT IT, AMIRITE? Sh-sheesh sorry for all that. ;;

Well I'll give you the "protection" thing. I was tempted to say "but I wasn't saying it was theft", and technically I wasn't, but it would be a lie to say I wasn't thinking it. And I agree, it's not really theft and it's definitely good advertising (thoooough I still wouldn't think very highly of someone not giving credit/linking to the artist). And I also agree that fanartists going apeshit over this happening is pretty silly, too. BUT, you cannot deny that some fanartists would. Whether you want them to or not, some of them are going to react badly when they find their fanart is being used for graphics on Livejournal without the creator of said graphics first asking for permission to use the images. And personally, I am sensitive to that. Maybe it's a little silly but I'd like them to get their way regardless.

Yeah, I can definitely see that argument. If I were an artist, I would DEFINITELY prefer to be linked to/credited, and would prefer to be asked or just alerted, if possible. And I'm all for not making people upset. It's not like I'm going to die if I asked someone to use a particularly gorgeous piece of art in an icon and they said "no" and now I can't do it. I mostly think the idea of policing it all is unnecessary- it would be better if more people asked when they could and EVERYBODY who could give credit, the same way I'd like icon makers to be credited (and for the same reason- always nice to know where something's coming from and be able to browse around!). But if they don't, it's not actually a deterrant to the iconists themselves if the artist flips out. It just paints the artist as unreasonable (at the VERY least in the iconist's eyes), espeically if they "flounce off the Internet" as someone said (and as they occasionally do) or attack the iconist in some way.

I don't know, I think iconists should go to more effort. Crediting if they know where/who to credit, and crediting if they didn't know but are later told. Asking permission if you speak that artist's language and can do so. (I tend to ONLY make Japanese fanart icons, because I would rather ask if I can, and I am incredibly intimidated to ask permission of English-speaking fanartists for some reason, so I tend not to make anything from those. XD;) But I think the fanartists and their supporters, like the OP, could also stand to calm down and think a bit more about it. Meeting in the middle would be nice... I can just cross my fingers and hope for it sometime in the future, I guess, but I can't see it incredibly soon, unfortunately.

Alright, you've convinced me. I'd still be pretty pissed and refuse to use a fanart icon if the artist wasn't credited, and I'm still thinking it's not such a bad idea to let the fanartist know about cases like that. But as long as it's credited, I suppose it's not so bad. Now, if the icon maker receives a request from the fanartist to remove the icons even if they're credited, I think the icon maker should respect those wishes. That'd be no different if there was official art involved. Asking for permission if they're able to AND listening to those "don't use our fanart" banners that are on a lot of Japanese fanart sites are also great things to do. But yeah, you've convinced me that fanart icons are not an absolute evil.
