They aren't hired on by the company who owns the copyright to draw the characters for one thing. No percentage of their sales go back to the originator at all. If they are profiting, in the eyes of the law it is illegal. It can be considered morally wrong. It's a overblown double-standard in fandom is what it is. Pretentious fanartists bite.

Not only fanartist make a profit from fandom. Costumers, those who make smaller crafts, and even some fanfic writers sell what they can do for money. Also comic book artists/ect. make plenty of profit on things not involved in the main project(ex. you go to a con and pay Bruce Timm to sketch Batman for you, none of that goes to the creator of Batman's family.)

But the anon above IS right though. It is illegal because none of the proceeds go to the company who owns it. Doujinshi, fanart, and the like are illegal, there's no ifs, ands or buts about it if you know about copyright law. The only exception is parody (at least in the United States, even Japan doesn't have a parody exception) and a sweeping majority don't fall into that. And in Japan, it does go against their morality part of their copyright laws.

But companies turn their heads because they see it as a fruitless endeavor to go against because the exorbitant legal fee and it would hurt the fanbase. Plus it's a convenient talent pool. Despite being illegal, it benefits everyone.
