1) Forstater harassed them on company time
2) Neither of them being dipshits makes their harassment okay. Both can be dipshits.

I'm glad that you think harassment is bad, and I assume you disagree with Forstater's position, which is (according to the mediating judge) that her opinion on a stranger's identity does giver her the right to harass them.

"I conclude from this, and from the totality of the evidence, that [Forstater] is absolutist in her view of sex and it is a core component of her belief that she will refer to a person by the sex she considered appropriate even if it violates their dignity and/or creates an intimidating, hostile, degrading, humiliating or offensive environment... [Forstater] could generally avoid the huge offense caused by calling a trans woman a man without having to refer to her as a woman, as it is often not necessary to refer to a person's sex at all... I do not accept that there is a failure to to engage with the importance of [Forstater's] qualified right to freedom of expression, as it is legitimate to exclude a belief that necessarily harms the rights of others... The human rights balancing approach goes against [Forstater] because of the absolutist approach she adopts."

It is by no means clear to me how any kind of misdeed by Murray could support the contention by Forstater that she has an absolute right to misgender people even when doing so constitutes harassment.
