I don't know this game at all, but DOES he commit genocide if you don't kill him or is it a choice between preventing genocide by killing him and preventing it another way that doesn't involve killing him? Or is he already no longer a threat when you have the choice to kill him, so the killing is just there for punishment?

Because if either of those are the case, then I'd agree with the game. Even if someone is evil, if you can prevent them from acting on their evilness without killing them and choose to kill them anyway, then you are evil too. Maybe not as evil as them, but evil nonetheless.
