Plagiarism has very little to do with the issues of fanworks versus original works as fanwork producers aren't generally lifting original creators' work whole or in part and claiming it as their own and if people are calling derivative works plagiarism, then yeah, that should be corrected. As for copyright law and intellectual property, well, there is a lot of gray area, especially when you start looking into what actually constitutes intellectual property and what has actually been judged an infringement. Still, it would behoove fanwork producers to realize that if a big publishing house or entertainment conglomerate decides that they are infringing, it could easily cost the fanwork producers a lot of money, regardless of whether there is any judgement in their favor, and that it could seriously affect fandom as a whole.
