I don't know the context of the latter case, but at least in the former I think stealing back a soul that originally belonged to the person who is stealing it is loads better than stealing some other person's soul. I mean, was someone else using Spike's soul...? Can you put transfer of ownership on something as intrinsic as a human soul? Seems kinda fucked up.
