She wasn't sampling. Sampling is using part of a pre-existing recording in one's song, and 99% of the time it is credited (and if it is not the person who sampled will probably be sued, unless the sampler's work is for free). Gaga took a melody from someone else and recorded it herself. I'm not saying that it then has to be stealing, but it isn't sampling, that's something specific.

I don't think she intentionally took the melody of "Express Yourself" or of any of the songs who she ripped from, but she apparently wrote the song in ten minutes and I don't think she stopped to realize that she subconsciously used a melody from one of her favorite artists.

She's given Ace of Base credit and the other artists she's used baselines from. I don't know if she did for Born This Way (that I have so many more issues with rather than it sounding like Express Yourself), but I doubt she's hiding the inspiration.

She hasn't really talked about it yet, so I'm hoping she'll say she was inspired by Madonna. I wasn't denying she was giving other artists' credit when she did sampling, more just trying to clarify what sampling meant and why it doesn't apply to Born This Way, since she made her own recording. (Yeah, I have other issues too, the "Express Yourself" thing is more just disappointment since she hyped this song up so much and it was musically boring. I wasn't expecting much from the lyrics, but I was hoping for something more interesting to listen to.)

Also I love that you have a Regina Spektor icon! My friend just gave me her Songs album, I really love it :3

As a fan of both artists, I've been uninterested in the drama surrounding this particular song, so I'm unfamiliar with the backstory. I was unaware that Gaga didn't have permission to use the melody; I guess I just assumed she did, similar to how one would use a sample (and similar to what she has done with other songs, like the aforementioned Ace of Base melody).

Didn't she actually write to Madonna before the release and send her the song being all "hey, lookit what I made" and Madonna was all cool with it? At least that's what I heard on the radio this morning...

Also, I thought that was the point: Born This Way was Gaga's love letter to Madonna, like ALejandro was to AoB, and the Telephone vid was to Quentin Tarantino. She's often very open about who/what inspires her.

When I first heard that song I was kind of confused, since I didn't recognize Gaga's voice offhand and it sounded so familiar. Then the DJ was like, "Born The Way by Lady Gaga" and I was all, "You're not Madonna. :("

No comment on whether or not it was "stolen," though - I have no idea what the story is behind that song and am too lazy to find out.

Dude. Gaga has ripped off others in some of her other songs as well. It's what her image is based on - she takes something from others and mixes it with her own. Why hate this particular song?

I'm not defending her, I'm just genuinely baffled why this song has brought out the hate. And btw, "Born This Way" is just as bad as "Dance in the Dark" when it comes to "ripping off". At least she gives credit where it's due, I guess?

I'm not following the news/fan reactions closely, so these are just my theories. Perhaps it's bringing the hate for two reasons. One, in the past people could, i think, just shrug off "Alejandro's similarity with AoB as coincidence, but it's happened again so maybe some people are getting suspicious. Also the song was hyped by Lady Gaga for a time, and while the lyrics are nice a lot of people (myself included) found the music itself boring. So I guess that's paving way for criticism.

Again I'm not closely following discussions, so these are just my thoughts. I'm probably not the best person to answer your question but I figured I'd go ahead and voice my thoughts. If anyone knows the answer I'd like to hear it too.

You're only now realizing Lady Gaga has been ripping off Madonna? Shall I point you to the Alejandro video where she practically stole half of it from Madonna's Blonde Ambition tour? There's a line between inspiration and stealing. Lady Gaga dancing along that line VERY closely.
