Seems to me the only one under obligation to conveying that essence is the original author.

If a fanfiction author doesn't stay true to what makes a character his-/herself, then I don't consider them to be writing about the same character; in my mind, they're just writing an original character with the same name.

Agreed.

I'd also like to point out that - if the story is written well-enough and the fic author's perception or interpretation of the character is based in canon - I can be persuaded of many, many things. Something's not OOC just because they're written differently than the exact way I'd choose to write it. A good, complex character has many facets, and a talented writer can effectively and credibly emphasize certain facets over others. Therefore, even if people do see characters differently, that doesn't mean we - as readers, writers, whatever - can't agree whether something is IC or OOC based on shared knowledge (i.e. canon).

Exactly. And that comes through quite clearly when you read a story. You can watch the progression of the character's thoughts from one point to another and see how they could logically come to behave a certain way based on their past experiences and the growth they've undergone. Some authors just skip over that growth and say "Hey it's a fanfic! They can do whatever I want them to do!" and that just grates on my nerves. I just feel like they don't care about the actual character at all.
