Woo boy, let's go through your points.

Yes he did. He was an adult who possessed a normal functioning brain, and he was in a country where having underage sex with a minor was and is illegal. Age of consent laws aside, he may also have already been in a relationship with Nastassja Kinski (who was between 15 or 17) at the time, and most folks sure as HELL know better than to cheat on their current girlfriends.

He thought that it was consensual sex since the girl's mother pretty much gave two thumbs up at the proposition of Romanski having some alone time with her daughter

A normal thinking adult knows that a girl's mother giving permission for her daughter to have a private photo shoot does NOT equal, "It's okay for you to have sex with her." And even if he thought it was consensual sex, he STILL shouldn't have touched the girl because oh yeah, she was kind of still a minor.

even though the girl objected at first, she stopped resisting after awhile

Said girl testifies she stopped resisting because, "I didn’t know what else would happen if I made a scene" and, "I figured well, I guess I’ll get to come home after this." Ceasing resistance does not equal giving consent. And even if she HAD consented it's irrelevant under California law.

Of course it was rape, but Romanski may not have been the brightest crayon in the box at the time it all happened (remember Sharon Tate, guys?)

Sharon Tate's murder happened in August 1969. The sexual assault happened in March 1977. That's eight years. I highly doubt Polanski's grief over Sharon or whatever was still clouding his mind. Even assuming he was still in a bad place mentally because of her murder, he STILL knew enough not to provide alcohol to and then have sex with a minor.

She was thirteen. She was off-limits. Even if she was consenting and complicit (and we only have his word on that and I'm disinclined to believe him), it was illegal for him to have sex with her. He did anyway. While she was telling him no. And may have been impaired by alcohol.

And I seriously doubt he's going to have sex with anyone who's underage ever again.

Oh, well, that's all fine and dandy but it doesn't change the fact that he committed a serious crime and has yet to serve his jail sentence for that crime.

Even though you preface your statements with "What Polanski did was unacceptable", these are damn troubling things to say and regardless of how you intended them they really make you seem like you're trying to whitewash the man's crimes.

This is not okay.

He lost his pregnant wife to murder. I can't imagine that's something you get over ever. People always go on about how damaging rape is, and it is, but I'd imagine that losing your pregnant wife to a random, violent murder is just about as hard to get over (I say having experienced neither).

Granted. He may very well have still been distraught about it after eight years. I'm still not seeing how it would lead him to think having illegal underage sex would be a good idea, or excuse him for doing so.

I agree, but it just seemed to come off as "Pfft! That was eight years ago, he'd be fine!" to me, though that might be my misreading.

I don't appreciate the snarky icon though.

Ah ha, I apologize that it came off that way then. That was poor wording on my part.

Also sorry about the icon. It's the only Rage-y icon I have and the statements did make me legitimately angry. I should probably get myself a new one though, if it comes off as snarky. My apologies.

You know what? Terrible things happen to a hell of a lot of people. People lose their partners, their children, their family members.
You know what most of them don't do in response? Anally rape an underage child. I don't care if you've seen your entire family slaughtered in front of you, if you're undergoing any sort of trauma. There are no excuses for rape.

I'm guessing the original anon wasn't excusing rape, but trying to say that Tate's murder turned Polanski kinda nuts (kinda being an understatement). I don't agree, but I can understand where that argument comes from.

Everyone should go read Jeffrey Toobin's piece in the New Yorker on Polanski from December 09. Very... enlightening. I'd link it but you can't read it all online. Alternatively it's in Best American Crime Reporting 2010.
