It's not about fictional characters having rights. That's silly. It's about the choices the writer makes. Everything about storytelling entails a choice on the part of the storyteller. Ideally, it should be a conscious choice, because that means the writer is actually paying attention to what they are doing and actually bothering to craft something instead of just slapping it together. If something has unfortunate implications (sexist, racist, bigotted, ignorant, etc), that means one of two things--the writer was deliberately choosing to make things uncomfortable (a valid storytelling decision) or that the writer genuinely feels that way about *insertunfortunatethinghere*
A character is never simple "a character" for the same reason that a story is never just a story. Something as simple as telling someone how your day went says worlds about you. Actually creating a fictional story where you have all the control in the world? It reflects on you and your perceptions of reality. And how other people interpret a work of fiction says just as much about them, whether or not they sit and think about it, or just take it as "just a story."
