Sure, Morgana is a sympathetic character to a POINT. She has reasons for what she does, yes. But basically what she did when she was reigning (for 2 seconds) was become the same tyrant Uther was, only for the non-magic people this time around. Hell, she doesn't give a shit if she kills the ones she used to consider her friends, like Gwen and Arthur. She has reason to want to kill Uther, and Merlin, but those who never betrayed her and were only worried for her? I don't understand why she's so quick to just wave off that entire part of her life, the good and the bad. (Personally I blame it on crap writing - the smirks alone! But I digress).
Not saying Uther isn't a collosal prick in his own right and that he doesn't deserve to be killed, but Morgana cared just as little about the innocent people who were in the wrong place at the wrong time and got killed because of that, as Uther does about the magic people who are just trying to lead their life.
Maybe Merlin is too pacifistic for you to be able to root for him, but I doubt doing the thing that basically make Uther reaffirm his views on magic users is doing the right thing. I actually have no idea what would be effective other than what Merlin is doing, since killing Uther with magic would only cause Arthur to become as mistrustful of magic as Uther is. Sure, I guess you can revolt against Uther and Arthur and put a magic user as the leader of the land who WILL respect both sides, but from the magic users in the show I see bare few who would fit that job description. Maybe Merlin himself, but lol I doubt he would ditch Arthur.

I don't find "killing Uther with magic would only cause Arthur to become as mistrustful of magic as Uther is" a good argument at all; if Arthur is this likely to go down the same path as Uther, then maybe he's not the ruler Merlin's looking anyway, and he should seriously reconsider even wanting him on the throne. And I don't see what was wrong with Gilli, for instances. Heck, I don't even see what was wrong with the guy from 1x12; sure, his methods were harsh, but that's besides the point: there was no sign that he'd go down the same route as Morgana if he was put into power. Not murdering heaps and heaps of people for no reason when you're in charge is not actually that weird a thing to do. If Arthur isn't capable of it, then what's so great about Arthur? I don't expect Merlin to see this, but they shouldn't expect the viewer to agree with the his POV.
I agree with you about Morgana, considering they turned her into a smirking cardboard villain (dude!), but I am furious about the fact they keep trying to sell maintaining the status quo and keeping Uther alive as the right thing to do.
