I wouldn't go against their policies, as an "artist" myself I can understand and respect that and I'd never create an icon unless I was given permission to do so by the artist. I just think it's a bit silly to put such restrictions on fanart. [Especially, when drawing fanart (or even write fanfiction) we don't seem to care if the creators really want us to do that or not]. Originals I could understand a lot more, but something that wasn't even yours to begin with? Ehh...if you're doing it to show off to your love of a fandom to other fans, why not let people show you their appreciation by creating icons? As long as they give you credit and link back to your URL or something. But, I digress, this is just my opinion.

Oh, I agree. I personally don't understand why an artist would set hard and fast restrictions against something like that. (I could understand saying no in some situations, but not for all types of use!) For me, the key is following the policies the artist gives, regardless of whether or not it's a fanart. I understand that fanarts are in a legal grey area, but all the same, it seems to me that they often have as much effort and love put into them as original pieces.

I just don't like the iconmakers who say "Well, those whiny artists don't have a right to tell me what to do with the art they put up here. I'll make icons just to show them how little power they have over this situation." It sounds hilarious, but I've actually heard that sort of statement.

Perhaps I'm biased, though, because I've been able to ask a few fanartists before if I could use their works on layouts or icons. I suppose for someone who can't communicate with the original artist, using without asking (or following policies they can't read or that are available only in butchered english) is the only real opportunity to use the art.
