I just don't like the iconmakers who say "Well, those whiny artists don't have a right to tell me what to do with the art they put up here. I'll make icons just to show them how little power they have over this situation." It sounds hilarious, but I've actually heard that sort of statement.
Perhaps I'm biased, though, because I've been able to ask a few fanartists before if I could use their works on layouts or icons. I suppose for someone who can't communicate with the original artist, using without asking (or following policies they can't read or that are available only in butchered english) is the only real opportunity to use the art.
