Ok fine if you want to get technical, that's true. But as usual I was shooting for BREVITY so what you are describing would fall under the "one person getting the other drunk on purpose" scenario. The intent to rape, the intent to force the other person or persuade the other person has to be there

God I hate how this fucking comm forces people to compose all of their comments like a god damn fucking legal treatise it's SO FUCKING ANNOYING. And I can't edit my comments here like on lj, just ugh, fuck

In my experience all of the internet is like that - nobody can read your mind, tone, or facial expression through pixels alone.

It isn't rape by DEFAULT, obviously, but it doesn't render rape impossible just because they're both drunk and start out wanting to have sex. People can change their minds in the middle of the act, express it, and be ignored or pressured. They can pass out in the middle of the act, and the other person keeps going (which might be okay with some people, but deeply problematic for others). Alcohol complicates responsibility in these situations (as I mentioned before, some people seem fine while black-out drunk), but it doesn't negate it entirely. Every case is different and blanket statements like the above quote seem dangerous to me.
