And I'm serious here (and gotten shit for it before, but that's another matter)...but, I've met people who will basically call anything with drug or alcohol involved "non-con" because it is their opinion that you can't ever consent in an inebriated state.
I'd personally would very much disagree with that, as I've had very much consensual sex when drunk before.
And this is where the dilemma begins.
Especially in fiction, where the character does what the author wants, and can't actually come tell you how they actually felt about it.
And just as a general thing: it's not because consent wasn't vocally given, that there wasn't any consent. Even in real life, often you do not go and ask people if they want to have sex - but a lot can be concluded from actions and body language.
SO I think it's actually a very fine line: I've seen some non-con/dub-con that I'd definitely call problematic - but other stories, I'd definitely not chuck in the rape category.
