Stolen Art?

So yesterday I came super late to the post, too late to really think anyone would see a comment, but I still want to ask f!s about this.

There was a secret about a book called Graceling, which is irrelevant except in that it has a particular dagger on the cover. My first thought was, “Hey, that looks like a Kit Rae design, maybe one of his earlier works.” (Kit Rae is probably the biggest name in high-end fantasy weapon design.) Lo and behold, I did a little digging and found the dagger to be a precise replica of the Lancelot Knife, except with the hilt tinted bronze and a small part of the grip slightly altered. It is exactly the same otherwise, from blade shape and hilt details down to the rune on the hilt that belongs to Kit Rae's own fantasy language. It's like someone took a photograph and fiddled with it a little, then slapped some photoshop filters in the background and pronounced it their own art.

Here's the kicker: there's not a single result for graceling + “kit rae” anywhere. Someone just stole his design and stuck it on the cover of a book without any kind of credit.

At this point, I'm not sure what to do, if anything. It's an obscure older design, so I'm not surprised no one caught this. I'm not even positive it's illegal, since Kit Rae does sell physical weapons along with his art. Even if the guy spends a ton of time and effort developing a fantasy universe with a cast of characters and several runic systems, photographs of physical objects aren't illegal to alter or sell.

It just sure feels unethical is all I'm saying.

Ask for advice/information in Artists Beware. The folks there know a lot about copyright law, so they should know what to do, and hopefully point you in the right direction.

If you think it's unethical, try to contact Kit Rae and inform him about the cover. He almost surely has his own standards as to what constitutes theft of his work, so he can pursue a case against the publisher if the image of the sword was stolen.
