It's called rape by deception. If the situation we're talking about comes to pass it would be something like this: MJ consents to sex her boyfriend, Peter Parker. However, it's not actually her boyfriend, it's Doc Oct deliberately pretending to be her boyfriend. She did not consent to having sex with Doc Oct. Therefore it's rape.

There's actually a real life case where a man was convicted of rape after tricking his identical twins' girlfriend into having sex with him.

I don't think that exists here. Not even sure you could prosecute someone for doing that in any way. But thank you for explaining.
