Real rape in the sense of "a stranger pulls a knife on you, drags you into an alley, and leaves you for dead," as opposed to someone deciding that a person who's hammered or passed out is fair game. Men have this tendency to only consider the former rape, most likely because defining rape to include the former means that we must consider a disturbing large segment of the male population as rapists.

Passed out is obviously a big no. But what if two people are both hammered and have sex. Who is the rapist?

I think if they are equally incapacitated, then neither is -- or both.
